The Hague Court of Appeal upholds the decision of the District Court, ruling that there is insufficient evidence that the specific goods will be involved in IHL / IHRL violations. nnn
It concludes that the minister’s assessment that there is no clear risk, as understood under the Common Position, is not unreasonable or incomprehensible. In particular, while acknowledging the severity of the human rights situation in Egypt, it finds that there is insufficient evidence that the specific goods in question will be used in violation of human rights, IHL and in the commission of internal repression.
