On 4 March 2024, a communiqué was submitted to the Office of the Prosecutor (OTP) at the International Criminal Court (ICC) to call for the commencement of a preliminary examination of, and thereafter, an investigation into crimes within the ICC’s jurisdiction that may have been committed by members of the Australian government, its officials, and the Leader of the Opposition, in the context of the ongoing situation in Palestine. The communiqué alleges that the Australian government and its most senior officials “have both failed to prevent or respond to the genocide committed by Israel against Palestinians in Gaza and been complicit in the carrying out of this genocide”.
