The High Court judge refuses permission to apply for Judicial Review. It rules that in light of the information provided by the government there is no realistic prospect of establishing the claimant’s arguments. It finds that the fact that NGOs and other respected bodies have expressed views on the risk of IHL violations does not make the conclusion by the Secretary of State irrational as those views have been taken into account as part of the decision making process.

The claimants immediately apply for a full High Court hearing asking for permission to bring a Judicial Review.
