The Court ruled that the complaint was ill founded because the claimants had failed to provide sufficiently precise and detailed evidence that the contested customs authorisations would infringe upon the right to life and the right to freedom from torture and CIDT of the Yemeni people. In coming to this conclusion, the Court did note that a link exists between the customs authorisations for the transit of goods on a Saudi cargo ship from a French port and the suffering of the Yemeni people, but still maintained that this was not an imminent emergency situation.
