The claimants summarise their grounds for appeal, namely that the rationale for denying NGOs access to justice does not hold as the civil path remains open, therefore it merely renders the process more complicated. Nevertheless, the claimants have submitted arguments for why they meet the threshold of standing even under the EU law framework, namely that they are directly and individually affected by the decision. It discusses the limits of adopting the EU law threshold when it comes to arms exports, and submits that Dutch law (the General Administrative Law Act) should apply and that the case be declared admissible.
