It is submitted that the claimants have failed to demonstrate the need for NGTS to intervene in the procedure, and find that the attributions made about their involvement in the export of the contested goods are unjustified. The co-defendants also uphold the arguments submitted by the government that the requested licensing information is confidential under the Official Secrets Act and its disclosure cannot be justified under the ECHR.
