Observations of the State of Israel on South Africa’s Request for the indication of provisional measures and modification of the Court’s prior provisional measures decisions

On 15 March 2024, Israel responded to South Africa’s urgent request for the indication of additional provisional measures filed on 6 March 2024 in the case concerning the ‘Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel)’ at the International Court of Justice (ICJ). Israel noted that South Africa’s arguments in its request misrepresent the reality of the events it has outlined and the humanitarian situation in Gaza. Israel further states that there has been no “change in the situation” that warrants new requests for additional provisional measures and that South Africa has not adequately demonstrated that the situation justifies the need for the specific measures requested. Overall, Israel submitted that the Court should refuse to accept South Africa’s latest request and not indicate any further provisional measures.
