It provides an overview of the domestic legal framework, namely the criteria and principles which should decision decision making on the granting of permits as well as emphasising that under South African law, a decision granting permission to export arms must ‘take all relevant considerations into account’ and be ‘rational’ and considering how these thresholds have not been met when it comes to the decisions of the NCACC to grant export permits to Saudi Arabia and the UAE.
