The claimants contend that the Netherlands is acting unlawfully in allowing the exports of military goods to the Egyptian Navy, due to the risk of  internal repression and IHL violations.nn

It is submitted that there is a clear risk that the proposed deliveries of military goods to the Egyptian Navy could contribute to, or even be directly used in, internal repression (in the north Sinai conflict), violations of fundamental human rights, violations of international (humanitarian) law (in Yemen) and/or otherwise would be in violation of the obligations of the Netherlands under the Common Position.
